This Terms of Service ("Agreement") is a legally binding contract between you ("you," "your," or "user") and BILLIONX LABS LIMITED ("we," "us," or "our"). This Agreement governs your access to and use of our entire suite of mobile applications (the "Apps"), websites, and all related digital services (collectively, the "Services").

By downloading, installing, accessing, or using any of our Services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you are not permitted to use our Services and must uninstall our Apps immediately.

Your use of the Services is also governed by our Privacy Policy. This policy explains how we handle your data, specifically our commitment to ephemeral processing of AI inputs.

Billionx Labs Limited provides a variety of digital tools, many of which utilize Generative Artificial Intelligence ("AI") to help users create, edit, or visualize content (e.g., design concepts, image editing, or text generation).

You acknowledge that the output of our Services is generated by AI models.

• "As-Is" Basis: Generated content is provided without guarantees regarding accuracy, suitability, or originality.
• Non-Professional Advice: AI outputs are for informational, conceptual, or entertainment purposes only. They should not be used as a substitute for professional architectural, engineering, legal, or medical advice.

"User Content" includes any data you upload ("Input Content") and the resulting AI-generated material ("Output Content").

• Ownership: You retain all ownership rights to your Input Content. Subject to this Agreement, you also own the Output Content generated by your use of the Services.
• Limited License to Us: To provide the Services, you grant us a temporary, non-exclusive, worldwide, royalty-free license to process your Input Content solely to generate your requested results.
• Our Commitment: As detailed in our Privacy Policy, this license is ephemeral. We do not store your images long-term, and we do not use your User Content to train our AI models.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Apps for personal, non-commercial purposes.

Prohibited Actions:

• You may not reverse-engineer, decompile, or attempt to extract the source code of our Apps.
• You may not use our Services for commercial purposes without our express written consent.
• You may not use bots or automated scripts to interact with our AI models.

You agree not to use our Services to:

1. Upload or generate content that is illegal, defamatory, obscene, or promotes hatred/discrimination.
2. Infringe upon the intellectual property rights of any third party.
3. Harass or harm others or bypass any technological security measures we have in place.
4. Upload viruses or malicious code designed to disrupt our infrastructure.

Excluding your specific User Content, all rights, title, and interest in the Services—including source code, UI/UX design, graphics, branding, and proprietary AI implementations ("Our Intellectual Property")—remain the exclusive property of BILLIONX LABS LIMITED.

• Advertisements: Many of our Apps are provided free of charge and are supported by third-party advertisements. We are not responsible for the content or privacy practices of these third-party advertisers.
• AI Providers: We may use specialized APIs (such as Google Gemini or OpenAI). Your use of features powered by these providers is also subject to their respective terms.

• No Warranties: The Services are provided "AS IS." We do not warrant that the Services will be uninterrupted or error-free.
• Limitation of Liability: To the fullest extent permitted by law, Billionx Labs Limited shall not be liable for any indirect, incidental, or punitive damages (including data loss or inaccuracies in AI output) resulting from your use of the Services.

• Governing Law: This Agreement is governed by the laws of Vietnam, without regard to conflict of law principles.
• Jurisdiction: Any legal action must be brought exclusively in the courts of Vietnam.
• Class Action Waiver: You waive the right to participate in any class-action lawsuit or class-wide arbitration.

• Termination: We reserve the right to suspend or terminate your access to our Apps at any time for violations of this Agreement.
• Changes: We may update these terms from time to time. Your continued use of the Apps after an update (marked by the "Last Updated" date) constitutes acceptance of the new terms.
